Pretrial Services Drug Testing

Pretrial Services provides drug/alcohol testing for detainees released on Supervised Own Recognizance. The testing results are used as a means to monitor the compliance on Pretrial release. Continued drug/alcohol use is reported to the Court which could result in additional sanctions or a return to custody.

Release conditions, including drug/alcohol testing, are court ordered by a judge. Drug/alcohol testing is conducted on a random basis. Pretrial Services follows a strict "chain of custody" process, and a gender specific staff person observes the collection of the specimen. Pretrial Services does not charge fees for these services.

Prop. 36 Drug Testing

Pretrial Services also provides drug/alcohol testing for individuals sentenced to Proposition 36 (Prop. 36).  The testing results are used as a means to monitor the compliance on Prop. 36.  The individual is ordered for Prop. 36 testing by the Santa Clara County Superior Court and the results are sent to the Santa Clara County Probation Department. 

Prop. 36 drug/alcohol testing is conducted on a random basis. Pretrial Services follows a strict "chain of custody" process, and a gender specific staff person observes the collection of the specimen. There is no cost associated with Prop. 36 drug/alcohol testing.
